2.     Under this privacy policy, you can find information about what personal details we collect and for what purpose. You will also find information about your rights with respect to such information.

3.     This privacy policy is applicable to all users of Our website, “mornov.com” (“Website”), even if they did not create an account; registered to Our mailing list; or placed an order.

4.     Before using our Website, please read this privacy policy carefully, as it shall be binding upon you. If you do not agree to this privacy policy, you are required to immediately cease from any further use of Our Website.

5.     We reserve the right to change, amend and modify this privacy policy, from time to time. Before entering Our Website, you are required to review the updated privacy policy, as the one being updated on the website shall apply on any of your use of our Website, at the time of such use.

What information do we collect?

 

7.     In order to supply the services on the Website and to improve your experience, we collect information which includes some identifiable information you provide Us with at the time of placing an order, requesting specific service or in the general use of the Website (for example: name, phone number, email address, address, ID and others) (“Personal Information”).

8.     Some Personal Information will also be shared with third parties we are working with to provide the services such as delivery companies (for coordinating your delivery), payment providers, clearance and credit card companies (for approval of the transactions) and other such companies, all in connection with the operation of the Website and its services.

9.     In addition to the Personal Information, We may also collect (by ourselves or through others) information that is not identifiable, which allows us to trace your activity on the Website for its proper functioning and maintenance, data security, and improvement of your browsing experience. For example, we collect statistical data on the use of the Website, duration of browsing, type of browser, location, your cart (including saving in cases where an order was not yet placed) and more (“Additional Information”).

10.  The Additional Information is being collected by example, by use of cookies. Cookies are small digital files sorting information about your browsing preferences and allows Us to remember them for your next visit. For example, cookies will allow Us to remember your cart when you revisit Our Website. You can always choose to remove tracking by cookies through the browser you are browsing from. In such event, some of Our services and Website functions may not be available to you anymore, or that you will have to reinsert specific details over again.

11.  We may also use “pixel tags” and other tracking methods, which may help Us to analyze your behavior and measure the effectiveness of Our Website and recommendations customized for you. This tracking method will enable Us to analyze which feature you use, links that you click on and other actions you take on our website.

12.  The Additional Information is also being collected by third parties, including Google Analytics, Meta, Shopify and are subject to their privacy policy that you can find here: Shopify; google ; facebook.

How do we use your information?

 

13.  We keep part of the Personal Information as part of Our legal obligations for record purposes. Some of the Personal Information is being used for improving your browsing experience or providing specific services; and some of the Personal Information is being used for providing you with technical assistance during your browsing.

14.  For some visitors, we will also use this information to use email marketing and updates about special events, discounts, offers and benefits – if they allow Us to do so.

17.  In some cases, We will be using your Personal Information to send you marketing content via email, WhatsApp, phone, notifications, or SMS (as we may choose, from time to time). We will use these to update you on promotions, special offers and benefits, events and to provide you with technical assistance and provide you details on your purchases.

18.  If you do not wish to receive such marketing content, you can easily click on the “remove” option (if applicable), or reply “remove” (if applicable) and such communication will be stopped within 3 business days following receipt of your removal notice. You can also just email Us at studio@mornov.com with a request to remove you from Our mailing list.

 

Your Rights

 

19.  Deletion of information shall be to the extent such is permitted by law or regulation.

20.  Before deletion of the information, you may be required to provide Us with additional identifiable information, for security purposes.

21.  Please note that once the data is being deleted, it may not be restored and some of the applications and option that you used, may no longer be available to you. 

22.  Excluding cases where deletion was requested, your information will be stored and secured by Us, at least to the time required by law.

 

Security

 

23.  For keeping the information of Our visitors safe, we take (by ourselves or thoruh others) security measures on our Website.

24.  Despite Our security efforts, no website is forever protected from breaching attempts and third parties’ attacks. To the extent We take standard security measures, We shall not be responsible for any such attempt or for any damage that can be caused by it.

25.  Any use of malwares, malicious software, viruses, and others on the Website is strictly prohibited. It shall be your responsibility to take precaution measures such as anti-virus, software updates and others.

26.  Our Website is not intended for children under the age of 16. We do not collect any personal information of children under the age of 16 and upon becoming aware of such event, We will dispose of any such information (to the extent permitted by law).

CCPA

27.  For purposes of this section “Personal Information” shall be as defined by applicable state privacy laws including the California Consumer Privacy Act (CCPA), and other states that have enacted comprehensive privacy laws.

28.  This information supplements other sections of this Policy and provides additional information for residents of applicable states in accordance with the requirements of Applicable State Privacy Laws. Information provided here details Our Personal Information processing practices in the previous 12 months and Our current Personal Information collection practices.  This section should be viewed in conjunction with the other portions of this Privacy Policy.  For example, We have described the Personal Information We collect, the sources from which We collect Personal Information, Our purposes for that collection, and how We disclosed Personal Information in this Policy. 

29.  Any Personal Information We collect may be provided to Our professional advisors, including accountants, auditors, consultants, and lawyers, when reasonably necessary for Our professional advisors to perform services for Us and give Us appropriate advice. Any and all personal information We collect may be given to another company in the event of a sale, merger, or other acquisition of some or all of our assets or business or as part of the negotiation or evaluation of such sale, merger, or other acquisition.

30.  We do not use or disclose Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the Applicable State Privacy Laws. If you are a resident of any of the Applicable States, you have the right to submit certain requests relating to your Personal Information or Personal Data as described below. To exercise any of these rights, please submit a request to us via email at studio@mornov.com. Please note that any such request will be subject to Our verification.

31.  We will not fulfill your request unless you have provided sufficient information for Us to reasonably verify you are the consumer about whom we collected Personal Information or Personal Data. We will typically not charge a fee to fully respond to your requests, but We may charge a reasonable fee, or refuse to act upon a request, if your request is excessive, repetitive, unfounded, or overly burdensome.

32.  CALIFORNIA RIGHTS DISCLOSURE:

32.1.Right to Know: You have the right to know about your Personal Information (including the categories of Personal Information we have collected about you; the resources from which such information has been collected; our business purposes of collecting such information; the categories of third parties to which we disclosed your personal information; the categories of personal information we sold or shared about you). You also have the right to obtain a transportable copy of your Personal Information. Your right to know request may be made no more than twice in a 12-month period.

32.2.In addition, and as mentioned above, you may request to correct the personal information We keep about you if such information is inaccurate (subject to our verifications).

32.3.As mentioned above, you have the right to request deletion of your personal information from Our database. In such event, please note that there may be some information that We will have to keep for legal purposes under CCPA.

32.4.You have the right to reject or withdraw consent from selling or sharing your personal information though tracking methods (such as cookies) by emailing us at: studio@mornov.com.

32.5.Under the Applicable State Privacy Laws you have the right to exercise your privacy rights twice in a 12-month period. 

Jurisdiction

33.  This Privacy Policy is part of our Website’s general Terms and Conditions and is subject thereof.

34.  This Privacy Policy together with the T&C’s are governed by the laws of Israel and the applicable court in Tel Aviv shall have sole governance over any dispute arising from or in connection with this Privacy Policy.

2. Terms & Conditions

Preamble 
1.    Welcome to mornov.com Website (the “Website”) (“We” / “Us” / “Our”).
2.    The headings in these Terms and Conditions (the “T&C”) are for convenience purposes only and shall not have any legal meaning or effect.
3.     Please read these T&C carefully, as any use of the Website is subject to them, and you will be legally bound by them.
4.    If you do not agree to these T&C (or any part thereof), we ask you to immediately stop from any further use of the Website. 
5.    By using this Website, you represent that you are over the age of 16. If you are above the age of 16 but under the legal age in the jurisdiction appliable to you, any use of the Website is subject to your parent or legal guardian consent. By continuing using the Website, you represent that such consent has been obtained.
6.    Any use of the Website shall be for legal purposes only. Any illegal action or action that may damage the proper function of the Website is strictly prohibited. 
7.    We reserve the right to change, amend and update these T&C from time to time, at Our sole and absolute discretion. The T&C that are binding to you shall be the updated T&C at the time of use of the Website. It shall be your responsibility to check and recheck the T&C and see if they have been updated, at any entry to the Website.

Terms of Sale
8.    When you make a purchase on the Website, you will be required to provide certain information including your name, phone number, email address and others. You will also be required to provide valid details of an international credit card (or such other payment alternatives, as may be available from time to time on our Website), which you are legally entitled to use. 
9.    Any purchase will be subject, in addition to the applicable terms of this Website, to: (a) the relevant policy of the credit card company, clearing company or other payment method company (such as PayPal, Apple Pay, or Google Pay - all if available on the Website); and (b) their authorization of the transaction. 
10.    We may be decline, restrict, or authorize any transaction, at our sole discretion, including when we find errors regarding the order or the details of the item.
11.    A confirmation of the order will be sent to you via the email address you provided at the time of placing the order. In the event that such confirmation was not received, please contact Us at:  studio@mornov.com.
12.    All orders will be supplied by a third-party delivery company, at Our choice and at Our sole discretion. You can find more details about our return Shipping & Return Policy <a href="/pages/policies">here</a> (including pricing and delivery schedules). We shall not have any responsibility over the schedule of the delivery, including delays that are due to your failure to fill, in a correct and complete manner, all information required, or due to your failure to coordinate with the shipping company the receipt of the delivery. The date and time of delivery shall be directly coordinated by you and the shipping company, and you shall make sure your availability to receive the item.
13.    If the event that the order is not authorized by the relevant credit card / clearance company / other payment provider, we will notify you via the email address you provided. In any such event, the order will be automatically declined, and the items will not be saved. 
14.    If you wish to return an item, kindly read about our Return Policy <a href="/pages/policies">here</a>.
15.    Our inventory changes from time to time. In the event that a certain item is not currently available, and We cannot supply it, any transaction placed for such item shall be declined and We shall refund you against such item. 
16.    We reserve the right to decline any orders from any customer with whom we have an ongoing dispute regarding a prior order. 

Prices
17.    All prices shown on our Website in NIS include Israeli tax at the applicable rate. For purchasers outside of Israel, prices are shown in USD/EUR. If you wish to purchase in UD Dollar or Euro currency, the final price of any items you purchase will be calculated in accordance with the applicable exchange rate on the date and time when the payment provider processes your payment. 
18.    Delivery charges are calculated in accordance with our <a href="/pages/policies"> Shipping & Return Policy </a>.  
19.    Although We try to make sure the information on Our Website is accurate and clear, it might be the case that some of the information on the Website will be incomplete or have unintentional errors or omissions. We will not be responsible for any such errors. 
20.    We reserve the right to update the prices of the items on the Website from time to time, and the delivery costs, without pre-notice. The effective price shall be the one presented at the time an order is placed. 

General
21.    There might be slight changes between how the items are presented on the Website and how they are in real-life (including minor changes in coloring or texture). For avoiding mistakes, please read the items’ description and specification before placing an order. You can also contact Our Customer Service on studio@mornov.com concerning a specific item. 
22.    We may offer, from time to time and at Our sole discretion, to some or all of Our clients, different benefits. These benefits will be subject to the applicable terms as will be specified further to you. You should read all specifications carefully. 
23.    Any error, caused due to force majeure or for any reason beyond Our reasonable control, will not be considered as a breach of these T&C and will not give raise to any claim or remedy to you. 
24.    We reserve the right to restrict, prevent or shutdown the access to the Website for visitors that have breached any of these T&C, applicable laws and/or regulations or if they have made unauthorized, illegal, immoral or defamatory use of the Website or of Our brand name. We shall not be responsible in such cases for any damage that may be caused to you as a result of such actions.
25.    We reserve the right to assign and transfer any of Our rights herein, to any third party and at Our sole discretion. 
26.    All information you provide to Us must be clear, updated and accurate. We will have no responsibility whatsoever for any damage, loss or other, results from or in connection with your failure to provide your information properly. 
27.    IN ANY EVENT AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE RESPOONSIBLE FOR ANY CLAIM, ERROR, OMMISSION OR ACT BEYOND THE EXTENT OF THE SCOPE YOU MADE PURCHASES ON THE WEBSITE. WE SHALL NOT BE RESPONSIBLE FOR ANY CONSEQUINTIAL DAMAGE OR LOSS CAUSED TO YOU (DIRECT OR INDIRECT) FOR ANY REASON WHATSOEVER, RESULTING FROM YOUR USE OF THE WEBSITE.

Social Media and IP
28.    All trademarks, trade names, trade masks, tradedresses, domain name, logos, copyright, slogans, passwords, designs, images, design patterns, design patents, fonts, videos, and content that are subject to intellectual property rights on the Website or as part thereof, shall be exclusively owned by Us (or third parties authorizing Our use). You shall have no right to them and are restricted from doing any use of them.
29.    The items shown on the Website are original designs of Mor Nov, and are subject to design patent protection (weather or not they are registered or unregistered designs under Israeli Design Law). You are strictly prohibited from making any copy, variation, model, derivative work similar to these designs. 
30.    Without derogating from any of the above, You shall not: copy, duplicate, publish, make derivative works of, or take any commercial action, not explicitly permitted by Us in writing, in Our intellectual property and in the content appearing on the Website.
31.    Any use of the hashtags: #mornov, #mornovjewelry or a tag/mention of our Instagram page: @mornov.jewelry or @mor_nov, on social media (including IG, TT, YU, FB and X), shall serve as your consent for Us to use that content for Our own commercial and marketing needs, at Our sole discretion. By using these tags, you hereby waive any claim of IP infringement against Us, including in relation to copyright and moral rights and any publicity or privacy claim associated therewith.  

Your further obligations
32.    You agree that any of your use of the Website shall be in accordance with these T&C and for legal purposes only. 
33.    You shall indemnify, hold harmless and protect Us against any damage, expense or claim with respect to your lack of compliance with these T&C.
34.    You agree that any purchase made on the Website shall be for personal use only. No wholesale is permitted. 
35.    With your receipt of the items, you are required to check their proper fit, size and other details, at your sole responsibility. In the event of a defect or mistake, please follow our <a href="/pages/policies"> Shipping & Return Policy </a>

Applicable Law and Jurisdiction
36.    These T&C’s shall be governed by and interpreted in accordance with the laws of the state of Israel. The Tel Aviv courts shall have sole jurisdiction over any dispute arising of or related to this agreement. 

3. Return, replace and cancellation policy

At Mor Nov, we hope that you will complete your order and receive your item and find it’s a perfect match!
If, however, you purchased an item and wish to replace or return it, please read these instructions carefully, as they shall apply to any replacement or return request. 
Any costumer who purchased an item they would like to return, may choose to get a refund, replacement or credit, subject to the terms herein:

Cancellations and Returns 
1.    You can cancel a transaction that was approved on the Website within 14 days as of receipt of the items, in accordance with applicable Israeli Consumer Protections Laws. Please note that this shall not apply to custom-made purchases, if available (such items will be non-refundable), or to purchases that were made physically at Mor Nov’s store (if available).
2.    If the transaction was cancelled while the item is still in our possession, you will get refund for the transaction, according to applicable laws and regulations. 
3.    If the transaction was cancelled while the items left our facilities, you are required to return the item to us on your expense, to the following address: 105 Jabotinsky st., Ramat Gan 5255320.
4.    Please note that in the event that the items have already passed to the delivery company, the shipping cost will not be refunded.
5.    If a purchase was made via a voucher, you can only get store credit, and not a refund.
6.    If the requested cancellation is for an item that was part of a package or a gift (buy one get one free for example), you can only cancel or request refund while returning all of the purchase that was made and all the items that were gifted or sold with a benefit or discount with such item. 
7.    Notwithstanding the above, we can decide, at our sole discretion that if an item was purchased as part of a promotion that included other items to receive such benefit, you can return the item and receive the item’s worth value as part of such promotion (for example, if you purchased an item as part of a promotion of 50% off the second item, and you wish to return the item that was 50% off, you will receive store credit for the amount of the item after the promotion applied and not its full value). 

8.    The refund will be provided to the credit card / other payment method you purchased with that the transaction was made through, within 21 days as of the day when the items were received at our facilities, and subject to the credit card company’s policy. 
9.    You can only return undamaged and unused items in their original box. 
10.    If the cancellation is due to: (a) a defect in the item (not caused by you or by natural wear and tear); (b) severe inconsistency with the item as presented on the Website and the item received; or (c) due to significant delay in the delivery of the item, not by your doing, you must inform us about such, and we will coordinate (by us or third party) a time and date for picking up the item and cancelling the transaction. 
11.    Notice of cancellation request of a transaction is possible via:

12.    A cancellation notice must include all details of the transaction, including order number; description of the returned item; ID; payment method; and if such cancellation request was provided by phone – an additional identifiable information. 
13.    In any event, and notwithstanding the above, any item that was specially and custom made for you, are not returnable, refundable or exchangeable. 
14.    Refund for taxes paid, shall be at your sole responsibility.
15.     Please note that some cancellation fees may apply, as applicable under the Israeli Consumer Protection laws. 

Exchange and Refund:

In addition to the above policies, any customer who wishes to exchange a purchased item with another, can do so, subject to the following:
16.    Exchanges are possible until 14 days as of receipt of the item.
17.    You must submit an exchange request by using this mail: studio@mornov.com
18.    Within 14 business days as of the day when the exchange item was received at our facilities, we will issue a personal voucher at the amount actually paid for the item
19.    The voucher shall be valid for 24 months after it was issued to you. 
20.    No exchange possible against vouchers. 

Shipping

21.    Shipping is available through third party courier and will be subject to the applicable courier’s terms and conditions.
22.    For domestic (IL) shipping is free of charge, and is expected to arrive within 1-4 business days for geographical locations within 20Km from Ramat Gan or within 14 business days for all other locations within Israel to coordinate pickup time and location.  
23.    International Shipping: international shipping is available for the jurisdictions specified below: USA, AU, NZ International shipping will be available through Israel Post – eco post, and is subject to Eco Post’s terms and conditions. International shipping will be charged ILS38 or equivalent (subject to exchange rates), for orders above USD $250 will be free of charge, and is expected to arrive within 5-7 business days. 
24.    You will be solely responsible for making sure all information you provided regarding the delivery is accurate and updated. It is your sole responsibility to make sure you are available to receive the item. 


This shipping and return policy is subject to our general T&C’s and Privacy Policy and is governed by the laws of Israel.
